TERMS AND CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

Introduction

These Terms and Conditions define the rules for the provision of electronic services by:

hereinafter referred to as the “Service Provider”.

These Terms have been prepared in accordance with:

  • the Act of 18 July 2002 on the Provision of Electronic Services,
  • the Telecommunications Law,
  • Regulation (EU) 2016/679 (GDPR),
  • the Polish Civil Code.

§1 General Provisions

  1. Use of the website constitutes acceptance of these Terms and Conditions.
  2. These Terms specify:
    • the types and scope of electronic services,
    • conditions for providing services,
    • technical requirements,
    • complaint procedures,
    • rules of liability.

Definitions

a) Terms – this document.
b) Service Provider – Goup Space Sp. z o.o.
c) User – a natural person, legal entity or organizational unit using the services.
d) Website – https://neoweblab.eu
e) Electronic Services – services provided without the simultaneous presence of the parties via ICT systems.

§2 Types of Electronic Services Provided

The Service Provider provides in particular:

  1. Contact form service
  2. Quote request form service
  3. Website order form service
  4. Handling of electronic inquiries
  5. Provision of information about NeoWeb Lab services
  6. Email communication with clients
  7. Implementation of website projects, CMS systems and IT solutions – based on a separate agreement

§3 Electronic Forms

  1. Forms enable Users to submit inquiries regarding services.
  2. Providing personal data is voluntary but necessary to process the inquiry.
  3. The Service Provider makes reasonable efforts to respond within 3 business days.

§4 Conditions for Concluding Agreements

  1. Information presented on the Website does not constitute an offer within the meaning of the Civil Code.
  2. An agreement is concluded:
    • based on an accepted offer,
    • based on an order confirmation,
    • through a separate written or electronic agreement.
  3. Detailed terms of cooperation are defined in an individual offer or agreement.

§5 Conditions for Providing Services

  1. The User is obliged to use the services in compliance with applicable law.
  2. It is prohibited to:
    • provide unlawful content,
    • attempt to breach security measures,
    • overload ICT systems,
    • infringe the rights of third parties.
  3. The Service Provider may temporarily restrict access to the Website due to technical maintenance.

§6 Liability

  1. The Service Provider shall not be liable for:
    • technical interruptions,
    • force majeure events,
    • actions of third parties,
    • incorrect data provided by the User.
  2. The Service Provider’s liability towards business clients is limited to the amount of remuneration paid for the specific service.
  3. Liability for lost profits is excluded.

§7 Complaints

  1. Complaints may be submitted:
  2. A complaint should include:
    • complainant’s details,
    • description of the issue,
    • requested action.
  3. Complaints are reviewed within 14 days.

§8 Minimum Technical Requirements

To use the services, the following are required:

  • a device with Internet access,
  • an up-to-date web browser,
  • enabled cookies and JavaScript,
  • access to email.

§9 Personal Data Protection

  1. The data controller is Goup Space Sp. z o.o.
  2. Personal data are processed in accordance with GDPR and the Privacy Policy available on the Website.
  3. Data may be processed for the purpose of:
    • handling inquiries,
    • executing orders,
    • commercial contact (with consent).
  4. Data subjects have the right to:
    • access their data,
    • rectify data,
    • erase data,
    • restrict processing,
    • object to processing,
    • lodge a complaint with the President of the Personal Data Protection Office (UODO).

§10 Data Processing Agreement

  1. In cases where project implementation requires processing personal data on behalf of a client, the parties shall conclude a separate Data Processing Agreement in accordance with Article 28 GDPR.
  2. Detailed conditions are specified in an individual agreement.

§11 Intellectual Property

  1. All content, materials and technological solutions constitute the property of the Service Provider or are used under license.
  2. Copying or distributing them without the Service Provider’s consent is prohibited.

§12 Amendments to the Terms

  1. The Service Provider reserves the right to amend these Terms in the event of:
    • changes in applicable law,
    • changes in the business model,
    • technical system modifications.
  2. Amendments take effect upon publication on the Website.

§13 Final Provisions

  1. Matters not regulated herein shall be governed by Polish law.
  2. Disputes shall be resolved by the court having jurisdiction over the Service Provider’s registered office, subject to consumer protection rights.
