TERMS AND CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

Introduction
These Terms and Conditions define the rules for the provision of electronic services by:

hereinafter referred to as the “Service Provider”.
These Terms have been prepared in accordance with:
- the Act of 18 July 2002 on the Provision of Electronic Services,
- the Telecommunications Law,
- Regulation (EU) 2016/679 (GDPR),
- the Polish Civil Code.
§1 General Provisions
- Use of the website constitutes acceptance of these Terms and Conditions.
- These Terms specify:
- the types and scope of electronic services,
- conditions for providing services,
- technical requirements,
- complaint procedures,
- rules of liability.
Definitions
a) Terms – this document.
b) Service Provider – Goup Space Sp. z o.o.
c) User – a natural person, legal entity or organizational unit using the services.
d) Website – https://neoweblab.eu
e) Electronic Services – services provided without the simultaneous presence of the parties via ICT systems.
§2 Types of Electronic Services Provided
The Service Provider provides in particular:
- Contact form service
- Quote request form service
- Website order form service
- Handling of electronic inquiries
- Provision of information about NeoWeb Lab services
- Email communication with clients
- Implementation of website projects, CMS systems and IT solutions – based on a separate agreement
§3 Electronic Forms
- Forms enable Users to submit inquiries regarding services.
- Providing personal data is voluntary but necessary to process the inquiry.
- The Service Provider makes reasonable efforts to respond within 3 business days.
§4 Conditions for Concluding Agreements
- Information presented on the Website does not constitute an offer within the meaning of the Civil Code.
- An agreement is concluded:
- based on an accepted offer,
- based on an order confirmation,
- through a separate written or electronic agreement.
- Detailed terms of cooperation are defined in an individual offer or agreement.
§5 Conditions for Providing Services
- The User is obliged to use the services in compliance with applicable law.
- It is prohibited to:
- provide unlawful content,
- attempt to breach security measures,
- overload ICT systems,
- infringe the rights of third parties.
- The Service Provider may temporarily restrict access to the Website due to technical maintenance.
§6 Liability
- The Service Provider shall not be liable for:
- technical interruptions,
- force majeure events,
- actions of third parties,
- incorrect data provided by the User.
- The Service Provider’s liability towards business clients is limited to the amount of remuneration paid for the specific service.
- Liability for lost profits is excluded.
§7 Complaints
- Complaints may be submitted:
- by email: info@neoweblab.eu
- in writing to the registered office address.
- A complaint should include:
- complainant’s details,
- description of the issue,
- requested action.
- Complaints are reviewed within 14 days.
§8 Minimum Technical Requirements
To use the services, the following are required:
- a device with Internet access,
- an up-to-date web browser,
- enabled cookies and JavaScript,
- access to email.
§9 Personal Data Protection
- The data controller is Goup Space Sp. z o.o.
- Personal data are processed in accordance with GDPR and the Privacy Policy available on the Website.
- Data may be processed for the purpose of:
- handling inquiries,
- executing orders,
- commercial contact (with consent).
- Data subjects have the right to:
- access their data,
- rectify data,
- erase data,
- restrict processing,
- object to processing,
- lodge a complaint with the President of the Personal Data Protection Office (UODO).
§10 Data Processing Agreement
- In cases where project implementation requires processing personal data on behalf of a client, the parties shall conclude a separate Data Processing Agreement in accordance with Article 28 GDPR.
- Detailed conditions are specified in an individual agreement.
§11 Intellectual Property
- All content, materials and technological solutions constitute the property of the Service Provider or are used under license.
- Copying or distributing them without the Service Provider’s consent is prohibited.
§12 Amendments to the Terms
- The Service Provider reserves the right to amend these Terms in the event of:
- changes in applicable law,
- changes in the business model,
- technical system modifications.
- Amendments take effect upon publication on the Website.
§13 Final Provisions
- Matters not regulated herein shall be governed by Polish law.
- Disputes shall be resolved by the court having jurisdiction over the Service Provider’s registered office, subject to consumer protection rights.
